But I think the problem is actually the other way around. That patterns are too easy to get around that is too easy to put up to troll and put up obstacles to someone trying to sue you for patent infringement. So I think it's easier to be a defendant of a pattern than it is to be a patent holder.

Okay, the only reason that it's easy to get around a patent is if the patent was not well written. A good patent attorney will write the claims of a patent so that competitors cannot make minor modifications and get around the idea. I've had patents of mind that I've drafted sell for over $100 million and no company is going to pay that amount of money if it can be designed around.
