Who does the name space force belong to? The United States military, or Netflix? Space Force is the name of a new branch of the US military designed to handle space warfare. Interestingly enough, it may have lost trademark rights to this name to a new Netflix comedy entitled, you guessed it, Space Force. The show filed for global trademark applications as early as January 2019. For the US government. Meanwhile, US Space Force currently has just a single pending application in the US for an intent to use. Now the US operates on a first to use trademark registration system. Does this mean or US military can lose its trademark to a Netflix show the chances of that are not likely. Fortunately, trademark law allows for parodies. So even if or when the federal government secures a trademark, the Netflix show would still have the same right to use the name. But the issue lies within selling merchandise with the Space Force name. If both the show and the military were to release clothing, or other merchandise that consumers might be confused by, as to who's selling the goods, there could be problems. And if a problem were to ensue, we know that the Defense Department would have no problem issuing trademark infringement warnings and lawsuits as it has done this in the past. As for now, all we can do is monitor and see how this unfolds in the future.
