Nick would like to know, in regards to trademarks, is a trademark—is a book title trademarkable?

No, you cannot trademark the title of a book. Now the reason that's confusing is—when I've mentioned this to people they'll say, “Well, what about the Dummies series?” And you know, Calculus for Dummies, Microsoft Word for Dummies, Starting a Business for Dummies, whatever it is, how do they—how do others not compete with them by creating unauthorized versions of the Dummies series of books? So one title is not—you cannot trademark one title. But if you have developed a business brand based on the title of books—it has to be a series—you definitely can protect that. The chicken soup series is another example, the Chicken Soup for the Inventor Soul, the Chicken Soup for the Patent Attorney, so whatever, they have, like, probably dozens, maybe even one hundred titles.
