Can a business model the way a company does business? What are the requirements for a patent is that the idea has to be novel, it has to be useful. It has to be non obvious. If it meets those requirements novel useful and non obvious, then you can get a patent. It has to also fit within one of four statutory classes. The business model is it is difficult to protect unless you have some technology involved. But these days it's very rare to have a business model that doesn't use a computer or software program. So I would not write off and ideas being patentable just because it's a business model. Because if it's a business that uses technology, there's ways to get it protected.
